Refusal of a Service Animal I am extremely disappointed with how this broker handled my driver and his legitimate service animal. The broker refused to allow my driver to proceed with the load because of his service animal. This is not simply a company “pet policy” issue. Service animals are protected under the Americans with Disabilities Act (ADA). Under 28 C.F.R. § 36.302(c), a public accommodation is generally required to make reasonable modifications to allow a service animal. A service animal may only be excluded in very limited circumstances, such as when the animal is out of control and the handler does not take effective action to control it, or when the animal is not housebroken. The ADA also specifically states that a person with a disability cannot be denied access simply because of the presence of a service animal, and businesses cannot require certification or documentation as a condition of access. What is particularly troubling is that this was not an unruly animal, nor was there some legitimate safety issue involving the dog. The issue was simply that the broker did not want the service animal there. That is unacceptable. Drivers should not have to choose between their livelihood and the assistance they are legally entitled to have because someone at a brokerage company does not understand—or does not want to follow—the law. I strongly encourage this company to educate its employees and brokers regarding the ADA and applicable Georgia law before putting another driver in this position. A service animal is not a pet. It is a disability accommodation protected by law. I would expect a transportation company working with professional drivers to understand and respect that.eir brokers refused our drivers service animal
